1. Acceptance of Terms

These Terms and Conditions ("Terms") govern your use of the NoteFill mobile application and services (collectively, the "Service"). By creating an account or using the Service, you acknowledge that you have read, understood, and agree to these Terms.

We reserve the right to modify these Terms at any time. We will notify you of significant changes through the App or via email. Your continued use after changes constitutes acceptance of the modified Terms.

2. Eligibility

You must meet the following requirements to use NoteFill:

• Be at least 13 years old (or the age of majority in your jurisdiction)
• Have the legal capacity to enter into binding contracts
• Not be prohibited from using the Service under applicable laws
• Provide accurate and complete registration information

Users under 18 should have parental or guardian consent to use the Service.

3. Account Registration and Security

3.1 Account Creation

To access certain features, you must agree to:

• Provide accurate, current, and complete information
• Maintain and update your information as necessary
• Keep your credentials confidential
• Notify us immediately of unauthorized access

3.2 Account Responsibility

You are responsible for all activities that occur under your account. We are not liable for any loss or damage from your failure to maintain account security.

4. Subscription and Payments

4.1 Free and Premium Tiers

NoteFill offers both free and premium subscription options:

• Free Tier: Limited to 3 AI-generated flashcard sets and 3 quizzes per day
• Premium Monthly: $3.99/month with unlimited AI generation
• Premium Yearly: $39.99/year with unlimited AI generation (17% savings)

4.2 Free Trial

Premium subscriptions include a 3-day free trial. You may cancel anytime during the trial without charge. After the trial, you will be automatically charged unless you cancel.

4.3 Billing and Renewal

• Subscriptions automatically renew at the end of each billing period
• You will be charged through your Apple ID account
• Pricing is subject to change with 30 days notice
• No refunds for partial months or unused periods
• Manage subscriptions through iOS Settings → Apple ID → Subscriptions

4.4 Cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. You will retain access to premium features until that date.

4.5 Refund Policy

All purchases are processed through Apple's App Store and subject to Apple's refund policy. For refund requests, contact Apple Support directly. We do not process refunds directly.

5. Acceptable Use

5.1 Permitted Use

You may use NoteFill for:

• Personal educational purposes
• Creating and studying educational content
• Tracking your learning progress
• Generating study materials using AI features

5.2 Prohibited Activities

You agree NOT to:

• Use the Service for any illegal or unauthorized purpose
• Violate any laws in your jurisdiction
• Share copyrighted content without permission
• Attempt to reverse engineer, decompile, or hack the App
• Use automated systems to access the Service (bots, scrapers)
• Abuse, harass, or harm other users
• Distribute malware, viruses, or harmful code
• Circumvent usage limits or security measures
• Create multiple accounts to abuse free tier limits
• Resell or redistribute the Service

6. Intellectual Property Rights

6.1 Our Content

The NoteFill app, including its design, code, graphics, interface, and functionality, is owned by us and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.

6.2 Your Content

You retain ownership of all content you create in NoteFill (notes, flashcards, quizzes). By using our Service, you grant us a limited license to:

• Store and process your content to provide the Service
• Use AI to generate study materials from your input
• Create anonymized analytics to improve the Service

We do not claim ownership of your content and will not use it for purposes beyond providing the Service.

6.3 AI-Generated Content

Content generated by our AI features is provided to you for your personal use. You are responsible for ensuring that AI-generated content does not infringe on third-party rights.

7. Privacy and Data Protection

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

By using NoteFill, you consent to our data practices as described in the Privacy Policy.

8. Third-Party Services

NoteFill integrates with third-party services including:

• OpenAI: For AI-powered content generation
• Apple App Store: For payments and subscriptions
• Analytics Services: For app improvement

These third parties have their own terms and privacy policies. We are not responsible for their practices or content.

9. Disclaimers and Limitations of Liability

9.1 Service "As Is"

NoteFill is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:

• Merchantability or fitness for a particular purpose
• Accuracy, reliability, or completeness of content
• Uninterrupted or error-free operation
• Freedom from viruses or harmful components

9.2 Educational Content

AI-generated content is for educational purposes only. We do not guarantee its accuracy, completeness, or suitability for any specific purpose. You should verify important information independently.

9.3 Limitation of Liability

To the fullest extent permitted by law, NoteFill and its affiliates shall not be liable for:

• Indirect, incidental, special, or consequential damages
• Loss of profits, data, or goodwill
• Service interruptions or errors
• Third-party actions or content
• Unauthorized access to your account

Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless NoteFill, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including legal fees) arising from:

• Your use or misuse of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Content you create or share

11. Termination

11.1 By You

You may terminate your account at any time by:

• Deleting your account through app settings

11.2 By Us

We may suspend or terminate your access immediately, without notice, for:

• Violation of these Terms
• Fraudulent or illegal activity
• Abuse of the Service or other users
• Non-payment of fees
• Extended periods of inactivity

11.3 Effect of Termination

Upon termination:

• Your right to use the Service ceases immediately
• You may lose access to your content
• We may delete your data after 30 days
• Outstanding fees remain due

12. Governing Law and Dispute Resolution
